I wouldn't expect it to work with 3.13, but I wouldn't blame the dev for that.
When apps are certified for a newer version of IOS they stop working on older ones, its always been like that, and I hate when my favorite apps are updated I am forced to update IOS too (which wasn't free before, I have spent 40$ in IOS upgrades).
I wonder what I will do once my Touch 2G will be phased out and denies updates...

I think that happened last week. There is no iOS 4.3 for the iPod Touch 2G. End-of-life.
